What are the steps involved in adjusting my family’s status?

To adjust your family’s immigration status, you typically must: 

  1. Determine their immigration eligibility: Check to make sure they can legally adjust their status and that they qualify for the right visas for the status adjustment.
  2. File an immigration petition: You can either have them file a family-based petition, which requires Form I-130, or a concurrent filing, which requires Form I-485 in addition to Form I-130.
